October 27th Police Shooting Within Departmental Policy

 

Huntsville, Alabama (November 8, 2007) On Thursday, November 8, 2007, an Incident Review Board convened to examine evidence and hear testimony related to a shooting incident from Saturday, October 27th, where two Huntsville Police Officers fired their weapons in self defense. Police Spokesman Wendell Johnson said the Board consisted of Captain Rodney Baker, Lieutenant Sherry Jackson, and Sergeant Jon Turis. Representatives from the City Attorney’s Office and the Madison County District Attorney’s Office were also present. Johnson said after careful review of the evidence, the Board concluded that the Officers decision to use deadly force was in accordance with Departmental policies and procedures. Chief Henry Reyes concurs with the Board’s findings and this part of the case is closed.

 

Johnson said 22-year-old Michael Anthony Novoa is still charged with two counts of Attempted Murder and a single count of Burglary First degree. He was charged on October 27th when Officers were dispatched to 2914 Moss Road in reference to shots being fired. When Officers Garland Franks and Gregory Hayden arrived on the scene, Novoa allegedly fired at the Officers and they returned fire in self-defense. No one was injured in the shooting.
